Supreme Cultural Revolution Council

Introduction

Given the emphasis of the Supreme Leader in correct and appropriate use of elite capacities in order to develop the country and the necessity of revolutionary movements in path of overcome the obstacles of knowledge production and software motion in meeting of some of the country's elite with him in October 1383, National Foundation of elites established by the statute as follows:

Chapter I: Generalities

Article 1 - Name

The name of the foundation is National Foundation of Elites which hereinafter in this statute is called briefly "Foundation".

Article 2 - Purpose

The purpose of the Foundation is planning and policy making in order to identification, guidance, material and intellectual support of the elites, attraction, preservation, applying and supporting them to promote science and technology production and balanced and scientific development of the country and obtaining the scientific, technological and economic top positions based on vision document on the horizon of 1404.

Article 3 - tasks

1-         Policy making and planning for:

A-         Material and intellectual support of elites

B-          Identification, guidance and support of elites to enhance the productivity of science in the country

C-          Discovery, attracting and nurturing talents and support of scientifically qualified persons

D-         Support of elites for research and entrepreneurship activities

2-         Coordination among organizations and institutions associated with the elite and monitoring their activities in order to implement the policies and approved programs

3-         Assist in providing necessary facilities in order to access researchers and elites to global researches and transferring new technologies to the country towards achieving balanced and scientific development of the country

4-         Assist in providing the necessary facilities for the elites in internal and external scientific conferences

5-         Formation of global network especially for Iranian elites inside and outside the country

Article 4 - Definition of elite and elites’ verification

Elite: refers to an outstanding and effective person in that his influence in science, art and technology production is evident and his intelligence, creativity, entrepreneurship and intellectual genius in line with the knowledge and innovation creation causes the acceleration of balanced and scientific development of the country. Elites’ verification will be based on proposed bylaw of the Board of Trustees and Supreme Cultural Revolution Council approval.

Article 5 - Legal form

Foundation is an independent legal entity and manages exclusively based on the provisions of this statute as a public institution under the direction of president. Head of the Foundation is vice president.[1]

Chapter II: Contributors

Article 6 - Contributors

The Foundation has the following contributors:

1-         Board of Trustees

2-         Head of the Foundation

3-         Elite Council

Article 7 - Board of Trustees

Board of trustees is the highest reference for foundation in the area of policy and decision making and has all the legal authority about aims and objectives of the foundation and its administration. The Board of trustees is chaired by the President of the Islamic Republic of Iran.

Article 8 - The board of trustees[2]

A-        Legal members

1-         The president (head of the board of trustees)

2-         First vice president

3-         Vice president and head of the Foundation

4-         Secretary of Supreme Cultural Revolution Council

5-         Minister of Science, Research and Technology

6-         Minister of Health and Medical Education

7-         Minister of Culture and Islamic Guidance

8-         Minister of Education

9-         Head of Management and Planning organization

10-       Head of the committee on Education and Research in Islamic Consultative Assembly

11-       Head of the Supreme Leader's representative at universities

12-       Head of the Academic Center for Education, Culture and Research

13-       Head of Islamic Azad University

Note 1: To promote the Foundation aims, head deputy of the Foundation is appointed by the board of trustees according to the approved criteria and in observation of conditions mentioned in article 10 of the statute.

Note 2: Provisions of the above members will be issued by the head of the board of trustees.

B-        Actual members[3]

They are nine persons of certified personalities and the country's scientific elite as actual members. Two of them are selected from theological schools’ prominent scholars by the Supreme Council of Qom theological school and two others are ladies of elites in the country.

Note 3: Provisions of the above members will be issued by recommendation of head of the Foundation and judgment of the head of the board of trustees.

Article 9 - Duties of board of trustees

1-         Determining the policies and programs and guidelines of the activities of the Foundation

2-         Adoption of required policies and programs associated with elites which are notified by the president

3-         Major policy and decision making about elites and approving internal and administrative bylaws for Foundation

4-         Review and decision making on the proposals of the head of the Foundation or proposals which are presented from at least one third of the board members

5-         Approving the organizational chart and required positions of Foundation

6-         Approving the budget and annual balance sheet of Foundation

7-         Approving bylaws in issue of how to provide moral and material support from Foundation for elites

8-         Coordination between agencies, centers and institutions that are in charge of the elite

9-         Offering suggestions about integration of institutions and organizational units of executive agencies to the relevant authorities which operate in relation to elites affairs.

10-       Approving statute of support funds in relation to the scientific elite, scientists and researchers

11-       Approving bylaws in issue of absorption and utilization of the country's scientific elite and how to provide moral and material assistance for them

12-       Approving required bylaws and regulations of the Foundation

13-       Review and decision making in matters that placed on the agenda of the board of trustees by head of the board of trustees or head of the Foundation and are in line with achieving the goals and performing basic tasks in the Foundation.

14-       Offering suggestions about modification or changing the statute to the Supreme Cultural Revolution Council

15-       Review and approving all proposed regulations from Elite Council

Note 1: Regular meetings of the board of trustees proposed by the head of the Foundation are formed twice a year. Each session is recognized in the presence of at least two-thirds of the members of the board of trustees and decisions will be valid by majority votes of members present at the meeting.

Note 2: Extraordinary meetings of the board of trustees establish in terms of necessity by recommendation of the head of the Foundation and the head of the board of trustees.

Note 3: Establishment of any institution associated with elite will be approved by confirming the relevant authorities of Foundation.

Note 4: the Board of Trustees can confer some of its duties to the permanent Commission of Foundation’s Board of Trustees, composed of some members of the board of trustees. egulations of formation process and duty description of the Commission will be approved by the Board of Trustees. [4]

Article 10 - head of the Foundation

Head of the Foundation (vice president) is the highest executive authority of the Foundation. Deputy of the Foundation is selected among the faculty members and meets the following conditions:

1-         He/she should have the scientific, research and administrative capability relating to the elite’s affairs.

2-         He/she should have brilliant academic and administrative records and should be familiar with elites’ community and their scientific needs.

3-         He/she should be familiar with international standardized criteria and mechanisms of elite educator institutions in the world.

4-         He/she should have adequate knowledge about scientific, administrative, financial, economic and planning and management systems.

Note: Head of the Foundation and his deputy are considered as education and research position.

Article 11 - A- The duties of the head of the Foundation

1-         Implementation of all resolutions of the board of trustees

2-         Managing and directing Foundation affairs and supervise the implementation of its activities in the framework of the statute, rules and regulations adopted by the Board of Trustees

3-         Managing the council of elites

4-         Financing necessary mechanism to operationalize the ideas of elites

5-         Coordination and conducting academic, executive, productive, services centers (governmental and nongovernmental) to absorb and recruit the elites

6-         Offering suggestions about modification or changing the statute to the board of trustees and then endorsement of the board of trustees in the Supreme Cultural Revolution Council

7-         Planning to strengthening the morale and religious, moral and national motivation of the elites in order to serve the country

8-         Providing annual reports of the Foundation activities to the Supreme Cultural Revolution Council

9-         Suitable and annual informing to public opinion about the activities of the Foundation

10-       Appointment and dismissal of employees of the Foundation and determining their salary in accordance with the rules and regulations of employment of the Foundation which is approved by the Board of Trustees.

11-       Preservation of property and movable and immovable assets of the Foundation

12-       Preparation of annual performance reports and submit it to the board of trustees to investigate

13-       Foundation representative in all judicial and administrative authorities with the right to substitution to get the rights of Foundation in the range of regulations

14-       Presentation of the balance sheet and the resource statement and the annual combined expenses of the board of trustees to approve

Article 12 - Elites’ Council

Elites’ council is the Foundation's scientific council in which the composition of its members consisting of the head of the Foundation (head of council), deputy, assistants of the Foundation and 7 persons as the main members who are appointed among elites with recommendation of the board of trustees and endorsement of the board of trustees and the decree of the head of the Foundation for 5 years. Conditions and characteristics of the members of elites’ council and their duties are determined by the board of trustees.

Chapter III: Finance and Administration

Article 13

Foundation budget is supplied from predictive aids in the country's annual budget row and actual or legal aids and gifts including governmental and nongovernmental.

Note 1: Foundation can use the benefits of all considered endowments for the support and guidance programs of the elites.

Note 2: The executive agencies can allocate parts of its annual budget to help the Foundation in the legal framework.

Article 14

Elites Foundation according to administrative, financial, transactional, employment and certain institutional bylaws and regulations which adopted by the board of trustees, obliged to obeying the law on public accounts, civil service management law and other general, administrative, financial and transactional and employment laws and regulations.[5]

Chapter IV: Miscellaneous Provisions

Article 15

The Foundation's main site is in Tehran and furthermore with the approval of the board of trustees can have internal and external subsidiaries.

Article 16

Movable and immovable property and rights and other facilities of the Foundation belong to government. In case of dissolution of the Foundation they will be delivered to The Institution of the Presidency.
